Updated 03/27/12 – 2:58 p.m.

CHICAGO (CBS) – A 36-year-old man has been charged with drunk driving for a crash that killed two children over the weekend in the Back of the Yards neighborhood.

Joey Chavez, of the 2200 block of South Saint Louis Avenue, was charged with two felony counts of aggravated DUI resulting in death, and two felony counts of aggravated DUI resulting in bodily harm. He was also charged with three traffic-related misdemeanors, including driving on a suspended license, and issued five traffic tickets, including two citations for disobeying a red light.

Chavez was ordered held on $550,000 bond on Tuesday. He was also hospitalized after the crash, but was booked into Cook County Jail on Tuesday.

Police said Chavez was driving south on Western Avenue at about 6:30 p.m. Saturday when he was involved in a hit-and-run crash with another vehicle that was heading north at 43rd Street. Chavez sped away from the scene while still heading south on Western when he rear-ended a Dodge Neon in the 4500 block of South Western Avenue.

Chavez’s SUV sustained severe front-end damage and the Neon was virtually destroyed by the impact. Witnesses said both cars flipped over during the crash.

Two children riding in the Neon — 10-month-old Julissa Ochoa and 5-year-old Eric Ochoa — were killed in the wreck. Their father, Eric Ochoa Sr., was seriously injured. Witnesses said their mother, Bernice Cabrera, was the only one who walked away, although she suffered a dislocated shoulder.

Witnesses said Bernice Cabrera was hysterical after the crash. As of Sunday night, she had not told the children’s father that the kids had died, as he was still recovering from his own injuries and his family thought learning of the children’s deaths would be too much for him.

Chavez was expected to appear for a bond hearing Tuesday afternoon.

Woman Arrested For Fatal 2011 Rollover Crash

RIVERSIDE, Ill. (STMW) – A 24-year-old Cicero woman has been arrested and charged with DUI and reckless homicide in connection to a fatal rollover crash that occurred in west suburban Riverside last December.

On Saturday, Riverside police arrested Magali Padilla, of the 1400 block of 51st Avenue in Cicero on one count of reckless homicide and one count of aggravated driving under the influence of alcohol causing a death. The charges stem from a December 7, 2011 rollover crash that took place at Longcommon and Delaplaine roads in Riverside.

In a release Sunday morning, Police Chief Thomas Weitzel said that his department’s investigators have been working this case nonstop since the day of the accident. Investigators reviewed crime scene evidence, hospital records, canvassed the area of the accident several times, worked in conjunction with the Illinois State Police accident reconstruction unit, and viewed countless hours of video surveillance.

The break in the case came when Riverside investigators found a video of Padilla leaving the parking lot of a restaurant in the 3000 block of Harlem Avenue in Berwyn at 11:40 p.m. on December 7, 2011. The accident took place at 11:43 p.m., some eight blocks from the restaurant. Police said that the video clearly showed Padilla driving the vehicle and not her passenger, Cesar Ramirez, 26, of the 2600 block of 75th Street in Woodridge. Ramirez was pronounced dead shortly after, at Loyola University Medical Center in Maywood.

Weitzel said, “The persistent follow-up investigation conducted by Riverside investigators certainly played a major role in bringing this case to successful conclusion. It is understandable that the victim’s family had been advocating for a quick resolution to this investigation, however, an arrest only came after months of factual evidence gathering and case preparation.”

Padilla was expected to appear in court for a bond hearing Sunday at the Cook County Courthouse at 26th and California.

Jamie O’Malley, 37, was charged with aggravated DUI, according to Cook County State’s Attorney’s office spokesman Andy Conklin.

Cook County Sheriff’s office spokesman Frank Bilecki said the driver in the crash was an off-duty deputy driving a personal vehicle.

WAUKEGAN, Ill. (STMW) – A Lake County grand jury approved reckless homicide and aggravated DUI charges Wednesday for the Bartlett man accused of being high on cocaine and under the influence of alcohol when he allegedly ran over a 10-year-old boy with his boat.

David Hatyina, 50, is accused of having a blood-alcohol level between .09 and .128 — above the legal limit of .08 — when Tony Borcia of Libertyville was killed on Petite Lake near Lake Villa on July 28.

The youngster was tubing with his family when he fell off the inner tube and was struck by the speed boat alleged to have been piloted by Hatyina.

Hatyina will enter his plea to the charges at his arraignment Sept. 10.

He is free from custody after having posted 10 percent of a $1 million bond.

Hatyina was arrested for operating a boat while under the influence on Chain O’ Lakes in 1996.

Tony would have been a fifth-grade student at Butterfield School in Libertyville.

WAUKEGAN, Ill. (CBS) – The young woman accused of running over and killing a 5-year-old girl in Highland Park on Labor Day has been indicted for reckless homicide and driving under the influence.

Carly Rousso, 18, was accused of huffing computer cleaning spray before she ran down a family of four in her father’s Lexus in downtown Highland Park on Sept. 3.

A container of the cleaning product was found in Rousso’s car, prosecutors said last month after she was first charged with reckless homicide and four counts of aggravated driving under the influence. At the time, she was freed on $500,000 bond.

On Wednesday, a grand jury returned an indictment on two counts of reckless homicide, and four counts of aggravated driving under the influence, according to the Lake County State’s Attorney’s office. She has been scheduled for arraignment on Oct. 18.

Rousso is due back in court Oct. 5.

Jaclyn Santos Sacramento, 5, was killed after the car Rousso was driving crossed several lanes of traffic and onto the sidewalk on Labor Day, slamming into the child and her family. Rousso is also charged with causing injuries suffered by Jaclyn’s mother, Modesta, and two brothers.

The accident happened in the 700 block of Central Avenue in Highland Park.

Jaclyn’s family has filed a wrongful death lawsuit against Rousso, accusing her of running over Jaclyn more than once, potentially backing over her in an attempt to flee.

After filing the suit last month, family attorney Bob Baizer said a local high school student interceded after Rousso struck Jaclyn and her family, and forcibly removed the keys from the ignition.

“It was completely instinctual and heroic,” Baizer said at the time.

WAUKEGAN, Ill. (CBS) – A Highland Park teen pleaded not guilty Thursday to charges she huffed a cleaning product before her car slammed into a family on Labor Day, killing a 5-year-old girl.

WBBM Newsradio’s Nancy Harty reports 18-year-old Carly Rousso did not speak during her court appearance, letting her defense attorney enter her plea of not guilty to four counts of aggravated DUI and two counts of reckless homicide.

Lake County prosecutors said she huffed an aerosol can of keyboard cleaner on Labor Day, before plowing her car into the Sacramento family on a sidewalk in Highland Park.

Jaclyn Santos-Sacramento, 5, was killed in the crash. Her mother, Modesta Sacramento-Jimenez, and her two brothers were also hurt.

Assistant Lake County State’s Atty. Ken LaRue said Rousso’s trial is slated to start Feb. 1.

“I anticipate this will be a lot of court appearances before it’s finally resolved; either a trial, or plea,” LaRue said.

The Sacramento family was not in court for Rousso’s appearance, but their attorney, Robert Baizer, was.

He said the crash was a horrible tragedy, and he expressed sympathy for Rousso’s family.

“My sympathy is brought to them, but it’s hard to be too sympathetic to Miss Rousso at this point,” he said.

Rousso’s attorney asked the judge to waive her need to appear at the next hearing in her case on Oct. 25, but the judge denied the request.

The judge did say that prosecutors need to provide the defense with their evidence about the aerosol cans allegedly found in Rousso’s car within the next seven days.

New DUI Charge For Man Convicted Of Killing 4 In Drunken Crash

LAKEMOOR, Ill. (STMW) – A parolee who spent nearly 12 years in prison for triggering a horrific drunken-driving crash that killed a McHenry County mother and her three children is facing new DUI charges.

Walter Depner was arrested Sunday night in northwest suburban Lakemoor — not far from site of the 1999 head-on collision that killed 34-year-old Eva Burleson and her children: Daniel, 13, Tiffany, 11 and Dallis, 7.

“Some people never learn,” McHenry County Sheriff Keith Nygren said Monday. “He just doesn’t seem to care.”

Depner received a maximum 14-year prison term after being convicted of aggravated DUI and reckless homicide in the Aug. 21, 1999 collision on Route 120. Tests after the crash showed he had a blood-alcohol level of .10 — above the state’s .08 legal limit.

Thomas Burleson, Eva Burleson’s husband and the children’s father, survived the 11 p.m. crash and testified that he was abruptly blinded by the headlights of an oncoming vehicle in his lane.

“I cannot explain it to you as quick as it happened,” Burleson told jurors at Depner’s 2003 trial.

Depner, who even at his sentencing insisted he wasn’t drunk and didn’t cause the crash, served almost 12 years behind bars before being paroled in June 2011, according to state records. His parole is scheduled to end this June.

He was arrested about 6:15 p.m. Sunday after McHenry County sheriff’s police received a call about a car running off the road near Lakemoor. A second caller who lived close by reported minutes later that a man had driven into his driveway, then walked uninvited into his home.

Police identified the man as Depner, saying his speech was slurred and he appeared intoxicated. Depner, who had lived in the neighborhood at the time of the 1999 crash, was taken for treatment to Centegra Medical Center in McHenry. He allegedly told police Sunday he went for a drive after quarreling with his girlfriend.

Depner was charged with DUI and driving on a revoked license.

The arrest also means his parole also could be revoked.

“This time, we were fortunate: no one was hurt,” said Nygren.

CHICAGO (STMW) – A southwest suburban woman was charged with aggravated DUI after a man was killed early Saturday when he was struck by a car as he walked on the Far Northwest Side near O’Hare Airport.

Sheryl Perry, 21, 2000 block of Sutcliffe Drive in Romeoville, was charged with felony count of aggravated DUI that caused accident or death, striking pedestrian in roadway, driving under influence of alcohol, driving without insurance and transporting or carrying alcohol.

The accident happened about 1:35 a.m. in the 5800 block of North Mannheim Road.

A 21-year-old woman was driving a PT Cruiser south on Mannheim and it may have been cut off by another vehicle, police News Affairs Officer John Mirabelli said. The woman swerved her car from left to right to avoid a crash, and in doing so she struck a pedestrian and a parked Volvo, which was disabled, Mirabelli said.

The man she struck may have been the owner of the Volvo, Mirabelli said.

Marek Bajson, 49, died after the accident, according to the Cook County Medical Examiner’s office.

An autopsy Saturday determined Bajson died of multiple injuries from an automobile striking a pedestrian and ruled his death an accident, according to the medical examiner’s office.

Perry is expected Monday in bond court.

WHEATON, Ill. (STMW) – A 32-year-old southwest suburban man has been found guilty of causing a fatal crash last spring that claimed the life of a motorcyclist in Naperville.

Michael Moreno of the 11700 block of Presley Court in Plainfield was found guilty of aggravated DUI (drugs) involving death, a Class 2 felony, for the June 15, 2012, crash, according to the DuPage County State’s Attorney’s office.

The verdict was handed down by Judge George Bakalis, who presided over a four-day bench trial, a release from the state’s attorney’s office said.

On June 15, 2012, at about 5 p.m., Moreno was involved in a road rage incident with another vehicle. Following the incident, he chased the other vehicle westbound on Ogden Avenue in Naperville, prosecutors charged.

During the chase, Moreno turned south on River Road, across oncoming traffic, and hit Gerald Puglise’s motorcycle. After hitting Puglise, Moreno drove away, but Naperville police apprehended him a short time later, prosecutors said.

Puglise, of Lombard, died at the scene of the crash. Moreno was taken to a hospital for minor injuries and tested positive for cocaine and marijuana, prosecutors said.

In all, Moreno was found guilty of two counts of aggravated driving under the influence of drugs involving death, one count of aggravated leaving the scene of an accident involving death), and one count of disorderly conduct.

Because the crash involved a death, he faces a possible prison term of up to 29 years. His next court appearance is scheduled for April 22.

CHICAGO (STMW) – A 70-year-old Far South Side man whose blood alcohol level was “extremely high” when he fatally struck a woman on the South Side in a 2011 hit-and-run is going to prison.

Sam Manyfield pleaded guilty Monday to aggravated DUI and leaving the scene of an accident, and Cook County Judge Stanley Sacks sentenced him to 10 years in prison, according to Cook County State’s Attorney’s office spokeswoman Lisa Gordon.

Manyfield was driving a Jeep Cherokee that struck 52-year-old Yvonne Williams about 8:50 a.m. on July 5, 2011, as she attempted to cross the 4600 block of South Ashland in the crosswalk, police said.

Williams, of the 5500 block of South Justine Street, was declared dead less than an hour later at John H. Stroger Jr. Hospital of Cook County. An autopsy found she died of multiple injuries from a motor vehicle striking a pedestrian.

Officers stopped the Jeep in the 1600 block of West 45th Street and took Manyfield into custody. His blood-alcohol level was “extremely high,’’ police said at the time.

Manyfield, of the 400 block of West 126th Street, was also cited for DUI, hitting a pedestrian in the roadway, driving on a suspended license and operating a vehicle without insurance, police said.

CHICAGO (CBS) – A Joliet man was charged with vehicular homicide after he drunkenly collided with a Chicago police cruiser Friday night — killing a passenger in his car while wounding himself, another occupant in the vehicle and two police officers.

Alex Reyes, 24, has been charged with reckless homicide, aggravated DUI resulting in death, aggravated DUI resulting in body harm and driving under the influence of alcohol, police said. He was also charged with driving on a suspended license, failing to keep in the lanes, driving in an uninsured motor vehicle, and two counts of damage to public property.

Reyes was driving a car carrying three people when he crashed into the squad car about 11:30 p.m. near Harrison Street and Laramie Avenue in the Austin neighborhood, authorities said.

An 18-year-old man, identified as Anthony Camarillo, of the 1300 block of South 56th Street, was ejected from the wreckage and died at the scene, according to the Cook County Medical Examiner’s office.

Camarillo suffered multiple injuries from an automobile collision and his death was ruled an accident, an autopsy determined.

Reyes and another passenger were critically hurt and taken to Mount Sinai Hospital, authorities said.

Neither of the officers who were struck in the crash suffered life-threatening injuries, police said. Both were taken to John H. Stroger Jr. Hospital of Cook County.

Reyes, of the 31000 block of Nantucket Drive, is still hospitalized and a court date has not yet been scheduled, police said.

ST. CHARLES, Ill. (STMW) – A west suburban man has been charged with being under the influence of heroin when the car he was driving plowed into the rear of a second car, killing an 11-year-old boy in February.

Benjamin J. Black, 28, of the 1500 block of Sparkhayes Drive in Sycamore, has been charged with three counts of aggravated DUI, according to the Kane County State’s Attorney’s office. He was also cited for operating an uninsured vehicle and failure to reduce speed to avoid an accident.

According to the state’s attorney’s office, Black had a controlled substance in his body when his vehicle he crashed into the car in which 11-year-old Matthew Ranken of Sycamore was a backseat passenger. The boy was killed and a passenger in the front seat was severely injured.

According to the Kane County Sheriff’s office, the crash occurred about 7:30 p.m. on Feb. 27 on Route 64 in western Kane County. Black was driving a 1999 Ford Expedition westbound on Route 64. Ranken was in a 1999 Chevrolet Cavalier, which was stopped, along with other vehicles, because of a crash farther west on Route 64.

Prosecutors said a laboratory analysis found heroin metabolites in Black’s urine sample, which was taken immediately after the crash, the release said.

A warrant was issued on Monday, and he appeared in court in St. Charles on Tuesday morning, when Associate Judge William Parkhurst set bond at $250,000, the release said. His next court appearance is 9 a.m. Thursday in front of Circuit Judge James C. Hallock.

If convicted of the most serious offense, Black faces up to 14 years in prison and fines of up to $25,000.

Lawsuit Settled In Alleged ‘Huffing’ Crash That Killed 5-Year-Old Girl

WAUKEGAN, Ill. (CBS) – A civil lawsuit filed in connection with the death of a 5-year-old girl last Labor Day, caused by a Highland Park teenager who was allegedly “huffing” a cleaning product beforehand, has been settled ahead of the teen’s criminal trial.

Court records indicated there has been a settlement in the wrongful death lawsuit filed against 18-year-old Carly Rousso, in the death of 5-year old Jaclyn Santos-Sacramento. Details of the settlement were not being made public.

According to news reports, Rousso’s attorney said there could soon be a plea agreement on the criminal charges, as well. Her trial was pushed back for the second time during a court hearing in Lake County on Tuesday – from July 12 to Sept. 27.

She has been charged with two counts of reckless homicide and four counts of aggravated DUI, accused of huffing computer dust cleaner minutes before crashing a car into Jaclyn, her mother, and her two brothers last year in Highland Park.

Jaclyn’s mother, Modesta Sacramento-Jimenez, and her two brothers – Daniel, 4, and Juan Carlos, 2 – survived the crash, and were not seriously injured.

Blood tests detected the chemical difluoroethane, which is found in commercial cleaning products, in Rousso’s system after the crash. A container of computer cleaning product was found in her car.

The lawsuit filed against Rousso accused her of backing over Jaclyn in an attempt to flee. An attorney for Jaclyn’s family has said a local high school student interceded after Rousso struck Jaclyn and her family, and forcibly removed the keys from the ignition.

Rousso, who turns 19 on Thursday, is free on bond, but has been placed on court-ordered curfew of 9 p.m. to 7 a.m., and must submit to random testing and home visits from authorities. She is not allowed to drive.

Judge Admonishes Rousso For Missing Court Date

WAUKEGAN, Ill. (STMW) – Highland Park 19-year-old Carly Rousso missed her court date Tuesday, after voluntarily checking into a treatment center due to mental trauma from the fatal accident she was involved in last summer.

Prosecutors said they have no problem with Rousso seeking treatment, but added that they still expect her to attend all court dates.

“I encourage her to get treatment,” said Assistant State’s Attorney Michael Ori at Tuesday’s hearing.

But Ori reiterated that her treatment is voluntary and her parents could have brought her to court. He also said prosecutors should have been notified ahead of time if she would not attend.

Rousso was to appear before Circuit Judge James Booras for a pretrial hearing on charges of aggravated DUI and reckless homicide stemming from the Labor Day 2012 incident on Central Avenue in downtown Highland Park, where she is alleged to have run over Highwood 5-year-old Jaclyn Santos after inhaling or “huffing” a chemical agent.

Judge Booras admonished Rousso in absentia for not appearing in court.

Her defense attorney, Douglas Zeit, responded that she is participating in a voluntary in-patient treatment program for stress- and trauma-related issues.

Rousso has been free on bail after her family posted a $500,000 bond.

The trial is scheduled to start Sept. 27, but Ori suggested that a plea agreement is possible before that.

A settlement has already been reached in a civil case against Rousso. The family of Jaclyn Santos filed a suit seeking damages in excess of $50,000. The settlement agreement was sealed.

Jaclyn was walking with her mother and two siblings on a downtown Highland Park sidewalk when she was run over by a car.

According to the lawsuit, Rousso was allegedly driving under the influence of difluoreothane, a cleaning agent.

The lawsuit alleged that Rousso drove over Jaclyn as her mother and siblings watched, then allegedly put her car in reverse and ran Jaclyn over a second time.

If convicted of the criminal charges, Rousso could spend up to 14 years in prison. She has pleaded not guilty to all charges.

Drunken Wrong-Way Driver In Deadly Ike Crash Had No License

Updated 09/09/13 – 2:12 p.m.

MAYWOOD, Ill. (CBS) – State officials said the man arrested for drunk driving in a fatal wrong-way crash on the Eisenhower Expressway this past weekend also was driving without a license.

Miguel Rico, 20, of the 2400 block of South Christiana, was driving a Dodge minivan west in the eastbound lanes of the Eisenhower on Saturday, when he slammed into a blue Ford near the Harlem exit, police said.

Three young women were inside the Ford, and two of them were killed.

Monica Hernandez, 20, of Maywood; and Briana Resto, 19, of Northlake, died in the fiery crash.

At the time of accident, he was wanted on an arrest warrant for allegedly violating his probation on a 2011 drug possession case. The Illinois Secretary of State’s office said he never had an Illinois driver’s license, and previously was convicted of driving without a license and speeding in 2010.

Friends and relatives of the victims showed up at the Maywood Courthouse on Monday, expecting him to appear for a bond hearing, but charges have yet to be filed in the crash. Illinois State Police said he was driving drunk at the time of the accident, and was expected to face aggravated DUI charges.

The Cook County State’s Attorney’s Office said it doesn’t know when he’ll be back in court. He was already being held without bond for the probation violation, according to the Cook County Sheriff’s office website.

Both families said they feel Rico should face more serious charges, such as reckless homicide.

Resto, Hernandez, and the sole survivor from the Ford – 20-year-old Brittney Mouzon – had been in school together for years, most recently at Proviso East High School in Maywood, according to relatives.

Resto’s mother said her daughter had just been promoted to supervisor at Baker’s Square. She was pursuing a career in criminal justice.

Hernandez’s uncle and aunt said she had a big smile, and she had just accepted a new office job.

“She was going to Triton [College in River Grove] and was just finishing gen ed courses, so she had her whole life ahead of her; just starting out, and for their lives to be cut so short … I can’t, it’s so unfair, and our lives are destroyed,” Hernandez’s aunt, Angelica Esposito, said.

Hernandez’s uncle, Raul Medina, said, “She was just like a daughter to me. … I mean, I helped my sister raise her, and she called me anytime she needed advice, or any kind of help. To me, this is a very big loss for us.”

Mouzon stopped by the courthouse in Maywood on Monday, hoping to see Rico in court. She described the moment Rico’s car slammed into the one in which she was riding on Saturday. She was in the front passenger’s seat, and saw the Dodge minivan coming straight at her.

“I look up, and all I see is a car coming towards us super-fast,” she said.

After the impact, Mouzon screamed for her life, and those of her friends.

“I was just shaking. I was like, ‘Wake up!’” she said. “I was just screaming, I was like, ‘Can somebody help my friends? Somebody help us!’”

Mouzon was joined Monday by other friends and relatives of the two women who died. They had been hoping to see Rico in court, but were disappointed to learn he wouldn’t be appearing until Tuesday.

“I wanted to … see the man that took my baby from me,” said Resto’s mother, Kathy Resto-Marquez. “I’m so lost, I’m so empty, I don’t know what I’m feeling. I only know I can’t touch her anymore. I love her so much. She was loved by everyone, and she touched so many lives.”

A wake for Hernandez has been set for Tuesday, from 2 p.m. to 8 p.m. at Bormann Funeral Home at 1600 Chicago Avenue in Melrose Park. Her funeral will be at 10 a.m. Wednesday at our Lady of Mt. Carmel in Melrose Park.

Resto’s wake will be Wednesday, from 4 p.m. to 9 p.m. at De La Torre Funeral Home at 2708 N. Western Av. Her funeral will be held there Thursday at 9 a.m.
