CHICAGO (STMW) — A west suburban woman pleaded guilty Friday to being the driver in a 2011 DUI crash that left one man dead in Riverside.

Magali Padilla, 28, pleaded guilty to being behind the wheel at the time of the rollover crash on Dec. 7, 2011, according to a statement from Riverside police. The vehicle she was driving struck a tree at Longcommon and Delaplaine roads at 11:43 p.m. before rolling over several times and landing in a front yard in the 200 block of North Delaplaine.

Both Padilla and 26-year-old Cesar Ramirez were ejected from the vehicle in the crash, police said. Ramirez, who lived in the 2500 block of South 75th Street in Woodridge, was pronounced dead at Loyola University Medical Center in Maywood shortly after the crash.

Padilla initially told investigators that Ramirez was the driver in the crash, when he was actually the passenger, police said. However, evidence at the scene did not support her story, and police later obtained a video showing Padilla driving the vehicle out of a restaurant parking lot eight blocks away at 11:40 p.m., just three minutes before the crash.

Padilla was arrested at her home in the 1400 block of South 51st Avenue in Cicero on July 7, 2012, according to police. She was charged with reckless homicide and aggravated DUI causing a death.

After Padilla pleaded guilty Feb. 5, Cook County Circuit Judge Paula Daleo sentenced her to two years of felony probation, twelve days of time served and a victim impact panel, police said. She was also ordered to pay $2,489 in fines and court costs.

CHICAGO (STMW) — A man has been charged with DUI after a crash left two children critically injured and another adult hurt Saturday morning in the East Garfield Park neighborhood on the West Side.

Ricky Pearson, 27, faces three felony counts of aggravated DUI causing an accident with bodily harm, according to a statement from Chicago Police. He was also charged with misdemeanor counts of DUI and driving on a suspended license; and cited for driving without insurance and disobeying a red light.

About 6:25 a.m., Pearson was driving his Mercedes eastbound on West Lake Street when he blew a red light at the intersection of North Hamlin Avenue and struck an Oldsmobile, according to Chicago Police. The crash caused the Oldsmobile to spin and collide with a Chevrolet.

Two boys were ejected from the Oldsmobile and taken to Mount Sinai Hospital in critical condition, police said.

The 25-year-old woman driving the Oldsmobile and Pearson were both taken to Stroger Hospital, where their conditions were stabilized, police said. Man Gets 16 Years For Drunk Driving Death Of Good Samaritan

CHICAGO (STMW) — Shane Stokowski died trying to help the man who ended up killing him.

Seeing an inebriated patron leave a West Town bar, Stokowski, 33, pleaded with the stranger who got behind the wheel: “You don’t want to do this.”

But Timothy McShane ignored Stokowski’s cries and hit the gas pedal, as Stokowski clung to the SUV in a desperate attempt to stop the intoxicated motorist.

Stokowski died when he crashed onto the pavement and was run over on March 22, 2014.

On Wednesday, Cook County Judge Lawrence Flood sentenced McShane to 16 years in prison, calling the rash actions that led to Stokowski’s death “outrageous and extreme.”

Minutes before in court, McShane, who had previous DUI arrests and has been enrolled in Alcoholics Anonymous since the fatal incident, wept as he apologized to Stokowski’s family.

Turning to face Stokowski’s loved ones, McShane cried, “I’m terribly, terribly sorry that Shane isn’t in your life, and I wish I could take it back.”McShane, 44, said he thinks about what he had done every day and has seen the pain in the eyes of the Stokowskis every time they have come to court.

Shane Stokowski’s mother, father and siblings weren’t impressed.

“He murdered my son with his vehicle,” Chris Stokowski said after court, wearing a T-shirt bearing a picture of her late son and his fiancee, Erin Harvill.

“I didn’t think anything of his apology. We’ve been coming up here for two years and there’s been no indication of remorse, no eye contact, nothing. . . . Too little too late.”

Shane Stokowski’s family described him as an upstanding, outgoing, funny and caring man who tried to cheer up those who were feeling down.

The graphic artist was to get married in October 2014. So the family went from planning a wedding to a funeral, Chris Stokowski told the judge.

She said as soon as she and her husband had learned that their eldest son was severely injured, they jumped into their car and drove toward Chicago from their home in Peoria. During the drive, the emergency room doctor called and asked them to pull over.

“I immediately got out my car and fell to my knees,” Chris Stokowski said, recalling how she received the devastating news.

Shane Stokowski’s fiancee’s parents also were in court on Wednesday.

Harvill, who now lives in California, had asked the Stokowskis if her remains could be placed in the casket she chose for Shane Stokowski when she died.

“I assured her that her life would go on. Shane would want that for her,” Chris Stokowski said, her voice shaking with emotion.

“I can never escape the memory of losing my brother,” Patrick Stokowski said. “. . . There are times when a moment reminds me of a time in the past when I was with Shane and I am happy, but that moment usually fades to sorrow.”The family said their loss has left them with such a profound sadness it has been hard to cope.

Assistant State’s Attorney Martin Moore said Shane Stokowski wasn’t the kind of person to sit back and watch a wrong be committed.

On the other hand, McShane was the type to ignore the warning signs that started since he received court supervision for a DUI in 1993, Moore said.

McShane was arrested for two more in DUIs in the suburbs in 2004 and 2006 but the charges were reduced.

Violating the law meant nothing to McShane, Moore said. And when Shane Stokowski came before him in the form of his final warning, McShane, who was driving his girlfriend’s Nissan Murano on a suspended license, was again dismissive, Moore said.

Shane Stokowski told McShane’s buddies that he was in no shape to drive. Even McShane knew that and went back inside the Aberdeen Tap, 458 N. Aberdeen, Moore said.

But McShane again left the bar from the back door and went to his girlfriend’s SUV.

McShane’s attorney, Thomas Brandstrader, told Flood that McShane has changed since he was charged in the deadly DUI.

While out on bond, McShane has been sober, started working at the Mercy Home for Boys & Girls and has strengthened the relationship he has with his 10-year-old son, the defense attorney said.

“The person sitting here today is not the person who was sitting at the Aberdeen Tap,” Brandstrader said.

In asking the judge for leniency for his reckless homicide and aggravated DUI convictions, McShane’s mother said her son suffered from ADD as a child and comes from a long line of alcoholics.

Timothy McShane’s son also had ADD and he does his best to help because he knows what the experience is like, Pat McShane said.

Pat McShane said her son has often expressed “remorse and sadness. She added that she hopes the Stokowskis will find “peace, understanding and forgiveness” in their hearts.

Flood noted that it took a tragedy for Timothy McShane to finally take responsibility.

“It took our son’s death for him to go AA, to go live in a halfway house, to get his life back in order” Chris Stokowski told reporters later. “It’s too little too late for us.”

CHICAGO (CBS) — A west suburban man has been sentenced to seven years in prison for driving drunk and causing a crash that led to a motorcyclist losing his leg more than two years ago in rural Kane County.

Quinn Gabnay, 46, was convicted June 3 of four counts of aggravated DUI by Judge Donald Tegeler Jr., according to a statement from the Kane County state’s attorney’s office. It was his third DUI offense.

About 5 p.m. on May 17, 2014, Gabnay was driving his Dodge Ram pickup north on Green Road, just south of Smith Road in rural Kane County, when he crossed the center line and collided with a Harley-Davidson motorcycle, prosecutors said.

The motorcyclist, who was southbound on Green Road, had moved near the shoulder to try to avoid the collision when he saw the pickup move into his lane, prosecutors said.

He pulled the motorcycle into the field next to the road, called 911 and applied a tourniquet to his leg while he waited for paramedics to arrive.

The collision severed the motorcyclist’s left leg below the knee. His entire left leg was later amputated and he now wears a prosthetic, prosecutors said.

Gabnay’s blood-alcohol content was .192 shortly after the crash, near two-and-a-half times the Illinois legal limit, prosecutors said.

Judge Tegeler sentenced Gabnay to seven years in prison Friday, according to the statement. He was given credit for five days served in the Kane County Jail. He has been free since his arrest on a $2,500 bond.

Man Gets 10 Days In Jail For Drunken Crash That Killed Cyclist

CHICAGO (CBS) —  There has been some outrage after a Cook County judge sentenced a Park Ridge man to only 10 days in jail and four years of probation.

Ryne San Hamel, 32, pleaded guilty to aggravated D-U-I and reckless homicide in the 2013 death of bicyclist Robert Cann.

Prosecutors asked for at least three years in prison for Hamel, who was driving near Lincoln Park almost four years ago when he struck and killed the bicyclist.

Kent College Law Professor Richard Kling said the sentence seems low, but there are other aspects of the case people should consider, including the cyclist reportedly running a red light.

“If this were a lawsuit where the family of the bicyclist were suing the defendant, one of the things that would take in a civil case is the relative responsibility and the comparative responsibility of each one of them,” he said.

Prosecutors said defendant Hamel had a blood alcohol level of .15 and was speeding.

The cyclist’s family has filed a civil suit.

Woman Charged With Driving Drunk With 3 Kids In Car

CHICAGO (CBS) — A 23-year-old woman was charged Monday with driving drunk in west suburban Riverside while three small children were in the car.

Lucero M. Reyes, of Chicago, was driving south in the 3500 block of Harlem at 12:54 a.m. when an officer clocked her vehicle driving 51 mph in a 35 mph zone, according to Riverside police. The officer then saw the vehicle swerve right and violently strike a curb, before driving up into the grass and veering back into traffic.

After pulling the vehicle over in the 3600 block of South Harlem, the officer smelled alcohol on Reyes’ breath, police said. After being asked for her license, she denied having one and told the officer she had previously been arrested in Riverside for driving without a license. The officer conducted a series of field sobriety tests at the scene, which Reyes failed.

During the stop, the officer noticed there were two boys, ages 5 and 12, and a 7-year-old girl in the car, police said. There were also two other highly intoxicated adults in the vehicle.

Reyes was then taken into custody and the vehicle was towed, police said. A second vehicle was called to take the intoxicated passengers and the children to the Riverside police station until family members could be contacted to take custody of the children. Investigators contacted DCFS for an endangerment complaint based on the fact that Reyes was driving intoxicated with the children in the vehicle, police said.

While in custody, Reyes said she had been “partying” and drinking “Bud,” or Budweiser, police said. Officers recovered open cans of the beer from the vehicle that were still cold to the touch.

Reyes submitted to a breathalyzer test, which showed her blood alcohol content at 0.124 percent, more than the legal limit of 0.08 percent, police said. She was charged with felony aggravated DUI, endangering the life of a child, improper lane usage, no valid Illinois driver’s license and no insurance.

Reyes, who had been arrested last April in Riverside and charged with driving without a license after being stopped for speeding, has never had a driver’s license and never attempted to obtain one in Illinois, police said.

The officer pursued the Expedition at speeds up to 75 mph until it hit a guardrail at Mitchell and Konen, police said. Upon searching the Expedition after the crash, officers found a loaded .40-caliber handgun and an unloaded .380-caliber handgun.

Morales, who lives in Aurora, was arrested and charged with aggravated DUI, aggravated fleeing and eluding, driving on a revoked license and speeding, police said. He was also wanted on a Kendall County warrant for driving on a revoked license and additional charges against him were pending. A 37-year-old woman who was in the vehicle with him was released without charges.

Another loaded gun was seized after a traffic stop Friday afternoon. Officers on patrol about 2:40 p.m. saw a 2007 Nissan Sentra that appeared to have illegally tinted windows, police said. When they went to stop the Sentra it quickly pulled into a parking lot in the 400 block of Sherman Avenue.

As officers approached the car, they saw the passenger, 21-year-old Delvion H. Pugh, “making movements as if he was trying to hide something” and placing something in the right side of his pants, police said. They found a loaded .44-caliber handgun in his waistband.

Pugh, who lives in Aurora, was arrested and charged with two counts of aggravated unlawful use of a weapon and one count of unlawful use of a weapon, police said. The 31-year-old woman driving the Nissan was released without charges.

Police said all three guns seized in the two incidents “appear to be illegally owned or possessed.”

Pugh posted $7,500 bail and was released from the Kane County Adult Justice Center on Monday, according to the Kane County sheriff’s office. Bond information for Morales was not immediately available.

About 2:20 a.m. Sunday, the 43-year-old officer was talking with a woman in the street in the 6800 block of South State when he and the woman were both struck by a maroon vehicle that was northbound at a high rate of speed, police said at the time. The vehicle sped away after the crash.

The officers were handling a possible domestic dispute at the time of the crash, police said. The officer and the 24-year-old woman both suffered injuries and were taken to Stroger Hospital.

Police later said the officer suffered multiple injuries and was in serious condition. The officer was released from the hospital Sunday afternoon and was expected to recover at home. The Chicago Fire Department said the woman was in serious-to-critical condition.

Police spokesman Anthony Guglielmi said both “will be OK.”

Hollingsworth, who lives in the Washington Park neighborhood on the South Side, also faces misdemeanor charges of driving under the influence of alcohol and was cited for damage to public property, failure to reduce speed and failure to exercise due care with a pedestrian in roadway, police said. He was scheduled to appear in bond court on Tuesday.

CHICAGO (CBS) — A man is facing felony charges after a passenger in his SUV was killed Sunday evening in a rollover crash in the Southwest Side Archer Heights neighborhood.

David A. Arocho, 24, was driving a 1996 GMC Carryall about 11:30 p.m. in the 4800 block of South Avers when he rear-ended a 2003 Jeep SUV that was stopped in traffic, according to Chicago Police. The GMC flipped over when it hit the Jeep.

A female passenger in the GMC was pronounced dead at the scene after she possibly fell out of the SUV, police and the Cook County medical examiner’s office said. Her identity had not been released Tuesday evening.

An autopsy Tuesday found she died of multiple blunt force injuries from the crash, according to the medical examiner’s office. Her death was ruled an accident.

Arocho was treated at Mount Sinai Hospital for non-life-threatening injuries, authorities said.

The driver of the Jeep, a 34-year-old woman, wasn’t injured, police said.

Arocho was charged with reckless homicide in a motor vehicle; aggravated DUI in an accidental death; drug DUI; failure to carry or display a driver’s license or permit; failure to reduce speed; operating a motor vehicle without insurance; and violating parole.

He was scheduled to appear in bond court on Wednesday.
